A mortgage modification under the HAMP program calculates a modified mortgage payment to equal 31 percent of a household’s gross monthly income. The mortgage lender is not obligated to grant a mortgage modification if it determines that the modified loan payment will result in a greater financial loss to the lender than foreclosing. If a mortgage lender determines that a modification is NOT feasible, then the lender is required, under HAMP, to offer alternatives to the homeowner, either in the form of a deed in lieu of foreclosure, or a short sale. Opting for a short sale allows a homeowner the possibility of prolonging the foreclosure process, and remaining in the property longer.
